Pompano Beach – Missing and rusted window screws, mismatched doors and holes in their building are some of the problems that have the residents of the 27-story Renaissance 1 condominium angry and anxious. Work stopped June 6 on a concrete restoration project for the building because the engineer left the project. “We cannot allow the job to go forward,” said Sandra King, public communications director for Pompano Beach. When a new engineer [with] approved plans comes in, work can begin again, King added. Until then, the residents of Renaissance I, 1360 S. Ocean Blvd., will be left with holes in their building and hurricane windows improperly installed. A stucco project running the vertical length of the building has also received criticism. Orange markings are sprayed at equal points up and down. “It looks so unprofessional,” said one resident.

To fix the windows, which were not installed properly and could be vulnerable to hurricane force winds, the residents have been asked to pay about $3,500 each. But after paying $2,000 last year for improvements that were later found to be done incorrectly, some residents are demanding the plans for the windows in writing. “What are we paying for if there’s nothing on record?” asked resident Joseph Longobardo. “There’s nothing to say what you’re getting . . . it’s like throwing money at the ocean.  Read more:

FLORIDA – Florida vet says, ‘Bring it on,’ as he faces eviction over flower pot flag

FOXNEWS.com:   Florida vet says, ‘Bring it on,’ as he faces eviction over flower pot flag
“…if anybody on that board told me they served in the military, I’d have to ask them which side”

A Florida veteran who is facing foreclosure for insisting on displaying a small American flag in a flower pot on his front stoop is telling his homeowner’s association to “bring it on.” “The flag is worth fighting for,” 73-year-old Larry Murphree, of Jacksonville, told FoxNews.com Friday. “If they want to foreclose, bring it on. I’m getting calls from all over the county to stand up. That’s what I’m going to do.” Murphree’s homeowners association at Tides Condominium at Sweetwater began hitting him with fines of $100 a day last year for violating his homeowners association’s flag display rules. But instead of paying the fines, Murphree let them pile up – and kept his flag on display. Now he owes more than $8,000, and neither side will budge.

“I just kind of dug in my heels,” he said. “It’s worth fighting for. It’s a small flag but it stands for a big thank you and it shows the love and respect I have for my country.” On Wednesday, Murphree told Fox News Channel’s Fox & Friends that his fight for the flag is with the board that runs the association. “I would think if anybody on that board told me they served in the military, I’d have to ask them which side,“ Murphree, who served six years as an Air Force air traffic controller during the Vietnam War, said on the show.

The fight started in 2011 and landed in court a year later where the two sides reached a settlement in which Murphree agreed to display his flag in compliance with association rules. But two weeks later, the board changed the rules, saying flags could only be displayed on a pole outside the garage and that flower pots were only for flowers.  Read more:

SUBURBAN LAKE WORTH, Fla. – A pet or a problem? A legal battle is brewing over a Palm Beach County family’s choice of pet.  The family’s homeowner’s association is cracking down on a pot-bellied pig named ‘Wilbur’. Wilbur may not seem too controversial. But in the suburban Lake Worth community of Cypress Woods, he is. The one year old, 65 lb. pot-bellied pig is at the center of a brewing legal battle between his owners and their homeowner’s association.”I didn’t know it was a problem until we got a violation letter,” said Rori Halpern, Wilber’s owner. “I didn’t want this to happen. I didn’t want to break any rules,” she said. Halpern said her HOA is trying to force Wilbur out. “I will fight, fight, fight with everything I have to keep this animal here.” She’s fighting so hard, she said, because of what Wilbur means to her two kids. Documents indicate that both have been previously diagnosed with ADHD and one of them with Asperger Syndrome. Halpern has even had Wilbur trained and registered in a Animal Assisted Therapy program at the Humane Society of Broward County.  Read more:

News & Record:  Greensboro councilman wants Heritage House closed, cites squalor
Records show that in the past 12 months, police or emergency responders visited the condo 2,860 times — an average of about eight visits a day.

GREENSBORO — Councilman Mike Barber wants the city to shut down the troubled Heritage House condominium complex after officials find alternative housing for residents. Until then, Barber said, he wants the city to hire armed, off-duty police officers to protect residents 24 hours a day. He cited high crime, unsanitary conditions and general squalor in the complex, including homeless people living in the stairwells. “We cannot simply let this issue bump along,” Barber said about the condos at West Meadowview and Randleman roads. “We need to take quick and decisive action.”

Barber’s comments came Friday, the same day a resident told the News & Record all four elevators are broken at the six-story high-rise.That’s reason enough for the city to condemn Heritage House based on a city ordinance, Barber said. But the city first must inspect the building, something that could happen as early as next week. Ben Holder, a frequent critic of conditions at Heritage House, filed a petition late Friday asking the city to inspect all 178 units — a request any resident can make. Heritage House has been a persistent problem for city and police officials for years.

Records show that in the past 12 months, police or emergency responders visited 2,860 times — an average of about eight visits a day.

The homeowners association also owes the city about $50,000 for past-due water bills. Read more:

Tankel’s slash-and-burn tactics got him suspended for 15 days in 2003 over what the Florida Bar called “harassment and intimidation”

For years, Robert Leon Tankel has been known as one of the most aggressive lawyers representing homeowners associations. Ownership groups had no stronger ally. Those who fell behind on their homeowner’s maintenance fees or assessments had no stronger foe. On Tuesday afternoon, authorities delivered Tankel to a new home, at least for the moment — the Pinellas County Jail.  Read more:

WTVM.com: Columbus condo owner (a double amputee) struggles to find solution for severe leak in roof
By Roslyn Giles
June 24, 2014
COLUMBUS, GA (WTVM) – The owner of a Columbus condominium is up in arms over who is responsible for repairing damage to her ceiling caused by a leak in the roof. Christine Bouyer called News Leader 9’s Roslyn Giles to help her sort through the conflict. Inside Bouyer’s upstairs bedroom, there are large cracks and water stains. From the looks of it, the ceiling could be on the verge of caving in. “This has been an ongoing problem. They’ve told us that they’ve fixed it, but as you can clearly see, it has not been resolved,” explained Estelle Bouyer.Estelle is the condo owner’s sister. She and other family members have been very involved in trying to help Christine resolve the matter, especially because Christine is a double amputee. “We’ve written letters. We’ve had meetings without any resolution at all,” added Estelle. News Leader 9 reached out to the Hidden Lake Condominium Association president. With Christine’s permission, the board president sent News Leader 9 the email correspondence between him and Christine concerning this situation. The emails date back to March and April of this year.  Read more:

The Stir:  Veteran May Lose Home Because He Displayed an American Flag  – $8,000 foreclosure lien on home
Freedom to Display the American Flag Act of 2005 in question
June 24, 2014
Sweetwater – What the heck is going on here? A veteran has been charged thousands by his HOA … for placing a small American flag in a flower pot on his front porch. And yes, this is happening in America. The Sweetwater Florida resident has been involved in a battle over his right to display the flag for two years, and it looks as though he may end up losing his home as a result of it.Veteran Larry Murphee says he just wants the whole thing to go away. “It’s such a minor little thing,” he explained. “They keep coming after me.” The offending flag is about the size of a sheet of notebook paper, just in case you were wondering. This hardly seems like it could be possible, yet Murphee claims the homeowners association has issued him a rather substantial fine for refusing to remove his patriotic decoration. “They just sent me a letter that says I owe them around $8,000 and they put a foreclosure lien on my house,” he said.Eight. Thousand. Dollars. For a flag. The lien is why he may be losing his home soon — according to the HOA’s attorney Michelle Haines, if he doesn’t pay the fine within 30 days, they can move forward on a foreclosure. Read more:

Houston Chronicle:  Condo Association, Dog Owner, Unit Owner Face Lawsuit in Dog Mauling Fatality
By Cindy George

Houston – Nearly six months after at least two dogs fatally mauled Christina Bell in southeast Houston, homicide investigators have turned the case over to Harris County prosecutors. City authorities initially responded to the attack by vicious dogs last January by issuing 12 misdemeanor citations to Tiara D. Thomas, 26, for allowing unvaccinated and unlicensed pit bull mixes to run loose. Animal control and Houston Police Department officials confirm that at least one of the dogs attacked Bell, a 43-year-old often homeless woman.

In the ensuing months, the deceased woman’s husband, Benjamin Franklin Bell, has filed a negligence lawsuit against Thomas as well as her rental unit’s owner and the condo association that governs the complex where she resided.  Harris County District Attorney’s Office spokesman Jeff McShan said that District Attorney Devon Anderson will decide whether to present the case to a grand jury but could not provide a timetable. WSB-TV: Residents outraged by car booting over HOA fees
June 24, 2014
By Amy Napier Viteri

DEKALB COUNTY, Ga. —  Neighbors in a DeKalb County condominium complex were upset after they say management arranged for their cars to be booted over outstanding homeowner’s association fees.  “I can’t even sleep at night, I get up and come look over the banister to see if I got more boots,” a resident who didn’t want to be identified told Channel 2’s Amy Napier Viteri.

She said she got a flat tire after her car got booted at the Ridge Creek condos in Clarkston. Several people said the same thing happened to them. Heritage Property Management, which maintains the complex, sent a letter to residents telling them anyone with outstanding HOA dues would be bootedu June 18. The neighbor told Viteri her boyfriend owns the unit and showed emails saying the HOA Board approved a payment plan for his dues.  Read more:
